Customers and/or Users are responsible for complying with all firearms laws in their area. Customers and/or users agree that if they purchase a firearm and do not have proper credentials to own it in their state or if the item is not state complaint they will cover all return shipping cost and return restocking fees. Customers and/or Users are to notify us immediately should you have any concerns about the legality of any product you have ordered. Any customer making a purchase through us agrees to follow all manufacturer safety instructions and to only use the product(s) in a safe manner in an approved area for a legal purpose. Customers and/or Users assume all responsibility for the legality of a specific item when you purchase it. Customers and/or Users must provide a valid contact phone number with any order placed. Customers and/or Users agree they are not an alien illegally in the United States. Customers and/or Users agree they have never renounced United States citizenship. Customers and/or Users agree they are not currently on Federal NICS or State agency DELAY/DENIED status regarding your most recent attempt to purchase a firearm. Customers and/or Users agree they have not been convicted in any court of a felony, or any other crime, for which the judge could have imprisoned you for more than one year. Customers and/or Users agree they are not under indictment for a felony, or any other crime that a judge could imprison them for. Customers and/or Users agree they have not been convicted in any court of a misdemeanor crime of domestic violence. Customers and/or Users agree they are not subject to a court order restraining you from stalking, harassing, or threatening anyone. Customers and/or Users agree they have not been discharged from the Armed Forces under dishonorable conditions. Customers and/or Users agree they have never been adjudicated mentally defective or have not been committed to a mental institution. Customers and/or Users agree they are not an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance. Customers and/or Users understand that cleaning, handling, or discharging firearms, ammunition or ammunition components may cause exposure to lead and they hold GunZoneDeals.com Inc. harmless and assume all responsibility for any lead exposure.

 

RETURNS

Firearm Returns – THIS IS VERY IMPORTANT! Please take your time to inspect all firearms thoroughly before proceeding with your transfer. Once a new firearm is transferred to you it is considered used, even if it is unfired. TRANSFERRED FIREARMS CANNOT BE RETURNED. We do understand that some manufacturer defects may not be identifiable upon initial inspection. However, upon discovering a defect after the transfer, it is best to return the firearm directly to the manufacturer for replacement or repair (in accordance with manufacturer’s warranty policy). By sending a defective firearm directly to the manufacturer, you can avoid the unnecessary transfer fees of returning the firearm to us through your local FFL dealer. We can certainly assist you through this process. GunZoneDeals.com Inc. will accept returns on firearms that have not been transferred but a 25% restocking fee plus any shipping charges will apply. GunZoneDeals.com Inc. does not reimburse FFL transfer fees on returned items. In some cases, a gift card/store credit will be issued for the refund. Refunds or store credits are not issued on item(s) until they are returned and inspected.

Please note that GunZoneDeals.com Inc. will not permit the return of the following products:

1. Special orders and products that are custom configured to your specifications.
2. Products sold "as is" or "used" or that have been installed or used after receipt.
3. NFA items that require ATF Transfer after the start of paperwork.
4. Ammunition, Illumination devices, electronic sights, optics, and night vision equipment.

 

NFA RETURNS

GunZoneDeals.com Inc. is unable to process cancellations, returns or refunds for silencers or any NFA items once the order is placed.

 

ACCESSORY RETURNS

Returns are only accepted on merchandise found defective immediately upon receipt. Accessory items that have been opened from the manufacturer packaging cannot be returned. Please note that GunZoneDeals.com Inc. does not accept returns for items that have been installed, mounted, or are not returned in their original manufacturer packaging. Most accessory items have a manufacturer warranty. Please contact the manufacturer if there are any issues after installation. Original shipping charges are NOT refunded if the item is NOT found to be defective. Customers and/or Users are responsible for return shipping. Returned orders will be subject to a 10% restocking fee if unopened and 25% restocking fee if opened. In some cases, a gift card/store credit will be issued for refund. Refunds or store credits are not issued on item(s) until they are returned and inspected.

 

AMMUNITION RETURNS

All Ammunition Sales / Ammo Components are Final and Non-Returnable. Returns cannot be accepted.

NOTE: We recommend that you use a carrier that offers shipment tracking for all returns, and either insure your package for safe return or declare the full value of the shipment so that you are protected if the shipment is lost or damaged in transit. If you choose not to use a carrier that offers tracking and insure or declare the full value of the product, you will be responsible for any loss or damage to the product during shipping. The customer is responsible for shipping charges both ways on returns, as well as for shipping charges on shipments that are refused or recalled.

 

PLEASE DO NOT ATTEMPT TO RETURN PACKAGES TO THE ADDRESS ON THE BOX. WITHOUT AN RMA WE WILL BE UNABLE TO VERIFY YOUR RETURN AND ISSUE A REPLACEMENT OR REFUND.

 

CANCELLATION OF ORDERS

We invest money and time to prepare every order that is placed on our website, even before the order ships. After you have placed your order online, over the phone, or through our Shoot First Pay Later program you will be charged a 10% Cancellation fee on the order total if you decide to cancel it. If an order has already been packaged and prepared for shipment or has shipped, then you will be charged a 25% cancellation fee on the order total if you decide to cancel it as well as any shipping charges. By placing an order online, over the phone, or through our Shoot First Pay Later program you agree to pay the cancellation fee plus forfeit any shipping and handling charges if you choose to cancel your existing processed order. If you choose to cancel an item or order that includes a product that you backordered or is a pre-order / special order, you agree to pay a 25% cancellation fee. Orders containing Silencers or any NFA items cannot be canceled. We would like to apologize for having to implement these charges, but our business is not set up to change orders easily and most times we are dealing in firearms not general merchandise.

 

CREDIT / DEBIT CARD CHARGEBACKS / NON PAYMENT

Customers and/or Users of this website agree that use of this website in any way constitutes a legally binding agreement to follow our Store Policies and Terms of Use. Customers and/or Users of this website agree that all Credit Card Chargebacks (or any other charge to us in any other form) will be actively pursued through Collection and/or Judicial and/or Legal means.

Customers and/or Users of this website agree that the following fees will be accessed on All Credit Card Chargebacks (or any other charge to us in any other form):

1. Customers and/or Users of this website agree to pay $25.00 per Filed Chargeback.
2. Customers and/or Users of this website agree to pay an Administrative Fee of $100.00 (or the maximum amount allowed by law if less than $100.00) per Filed Chargeback.
3. Customers and/or Users of this website agree to pay for Original Chargeback Amount, All applicable fees, All collection recovery costs, All incidental costs (including Travel, Hotel and Meals), and All Attorney Fees involved in collecting any monies owed to GunZoneDeals.com Inc.
4. 5. Customers and/or Users of this website agree to pay our Collection Agent, Midwest Fidelity Services (or other Collection Agent we assign), any and all monies owed GunZoneDeals.com Inc. including a fee of 30% of the total owed to GunZoneDeals.com Inc. on accounts less than 1 year old. A fee of 40% of the total owed will be charged in addition to the amount owed to GunZoneDeals.com Inc. on accounts over 1 year old.

 

ONLINE PRICE / DESCRIPTION ERRORS / SHIPPING ERRORS / AVAILABILITY

Occasionally we have only one item in stock and more than one person orders it. When this happens, we honor the first funded order. If we run out of stock, we will cancel your order and fully refund your money. Our online inventory changes every day. Occasionally an item may appear on the site by mistake or the item's description may contain a typographical error. We do not guarantee that titles, descriptions, pictures, or prices on our site are complete, error-free, reliable, or current. GunZoneDeals.com Inc. streams live prices from several different distributors. Due to availably and price changes between these different distributors all sale prices are final. Price adjustments are not eligible on any order that has been placed and we cannot issue a raincheck for sale priced items. We reserve the right to refuse any order including but not limited to orders for items with errors in the description or price. We also reserve the right to refuse any order where a nonvalid coupon code is used. Please note that if paying by money order your item(s) are not secured until payment in full is received. In the event that we cancel an order we will refund your money or issue a gift card. If the order is mistakenly shipped, we may advise the customer to return the item(s) in an unopened condition and we will refund the customer or the customer will pay for the item(s). By placing an order, the customer agrees that the seller will be the final arbiter of any discrepancies.

 

USED FIREARMS

The seller provides all descriptions for used items. All descriptions for used items are honest and based on actual items being offered for sale. Items being sold in this manner will be marked as such. All sales on used items are final. Photos will be provided when available.

 

SHIPPING

Most individual firearms and accessories ship for $9.95 to $24.95. This excludes firearms shipping to Alaska and Hawaii. Whenever possible, GunZoneDeals.com Inc. will combine shipping. Certain firearms and accessories can be drop shipped from various warehouses, causing the shipping rates to increase or vary. Any firearm or accessory shipped from another warehouse can incur additional shipping cost. Shipping insurance is offered and is optional. GunZoneDeals.com Inc. is not responsible for uninsured items lost or damaged in transit. If you would like to review the total shipping charges for your order this can be viewed in in the cart prior to checkout. All shipping and handling charges cover the cost of standard shipping. Expedited shipping can be requested but shipping fees will be greater. You must contact us at Sales@GunZoneDeals.com for a quote. We will always do our best to process and ship orders within 3-10 business days upon receipt of full payment and a valid FFL. Occasionally these lead times can change due to current events and/ or order volume.  These lead times exclude NFA items and special-order items. GunZoneDeals.com Inc. offers shipping to addresses within the United States only. The cost to ship to Alaska and Hawaii varies by item, shipment, and shipping option. Shipping method and rates to Alaska and Hawaii will vary. Any advertisement of free shipping is not applicable for Alaska and Hawaii. GunZoneDeals.com Inc. will not ship to any international destinations including Puerto Rico. Due to a large increase in fraudulent orders, GunZoneDeals.com Inc. requires the billing address and shipping address to match for all non-FFL items being shipped for any order. If an exception needs to be made to this policy, please contact us before placing your order. State Identification will be required. We apologize for having to implement these requirements but to keep fraud down and prices low it is something we must now do. Non-FFL items ordered will ship to the billing address. GunZoneDeals.com Inc. will not ship to P.O. Boxes. GunZoneDeals.com is not responsible for missed or unclaimed shipments. All customers agree to cover any additional shipping cost or restocking for returned shipments or for shipments that need to be reshipped. All customers agree to cover the actual shipping cost on any order returned that had free promotional shipping. GunZoneDeals.com is not responsible, nor will they get involved with special shipping instructions or arrangements made between FFL's, Customer's, and shipping carriers.

 

RISK OF LOSS

All items purchased from GunZoneDeals.com Inc. are made pursuant to a shipment contract. The risk of loss and title for such items pass to the customer upon our delivery to the carrier.

GunZoneDeals.com Inc. has no affiliation with any FFL’s on the list. Be aware that it is customary for your local dealer to charge a transfer fee at the time you pick up your purchase. These transfer fees can vary by region and dealer. Transfer fees are strictly between you and your local dealer. GunZoneDeals.com Inc. will not get involved in issues or problems between Customers and/or Users and the FFL selected for pickup. Certain dealers also apply sales tax. Please check with your local dealer concerning their policies. The actual transfer of the firearm, transfer fees and sale tax will be between you and your FFL dealer. GunZoneDeals.com Inc. does not guarantee information provided by any other FFL dealers or their websites. Customers and/or Users are responsible for contacting the transferring FFL to get approval for the transfer prior to placing an order with GunZoneDeals.com Inc. It is also the Customers and/or Users responsibility to contact the FFL and have them send a copy of their FFL to us via email at FFL@GunZoneDeals.com or fax at (260) 240-2002. It is the Customers and/or Users responsibility to ensure that a firearm you are transferring is legal to own in your state. GunZoneDeals.com requires an FFL for all muzzleloader and black powder firearm shipments. Additional shipping cost can apply to orders that experience shipping issues with the FFL Dealer you choose. GunZoneDeals.com is not responsible for missed or unclaimed shipments and all customers agree to cover any additional shipping cost for returned shipments or for shipments that need to be reshipped. GunZoneDeals.com is not responsible, nor will they get involved with special shipping instructions or arrangements made between FFL's, Customer's, and shipping carriers.

 

CLASS 3 SHIPPING – FFL TRANSFERS

GunZoneDeals.com Inc. will only ship CLASS 3 ITEMS to individuals or agencies with a valid FFL (Federal Firearms License) and SOT. In some cases, GunZoneDeals.com Inc. may choose not to ship class 3 items to certain dealers. Though these dealers may appear on a list these dealers could be flagged and may not be used for transfers. The list on GunZoneDeals.com is there to provide you with a convenient way to see what local FFL dealers are in your area. Not all FFL dealers are class 3 dealers, so the Customer and/or User is responsible for identifying a dealer that has a SOT.  Customers and/or Users may use local dealers that are not on the list by contacting us through the HelpDesk or emailing us at FFL@GunZoneDeals.com. GunZoneDeals.com Inc. has no affiliation with any FFL’s on the list. Be aware that it is customary for your local dealer to charge a transfer fee at the time you pick up your purchase. These transfer fees can vary by region and dealer. Transfer fees are strictly between you and your local dealer. Customers and/or Users are required to complete an ATF Form 4 with their FFL dealer and to pay the relevant tax stamp fees.  The Form 4 requires fingerprints and photos that must be completed by Customers and/or Users.  GunZoneDeals.com Inc. will not get involved in issues or problems between Customers and/or Users and the FFL selected for pickup. Certain dealers also apply sales tax. Please check with your local dealer concerning their policies. It is your responsibility to ensure that a firearm is legal to own in your state. All new firearms are shipped in the original manufacturer's box, with magazine(s), accessories, and applicable warranty. Firearms requiring warranty work must be returned to the factory within 1 year of purchase for repair. Accessories and special-order items not normally sold by our store will not be covered under warranty even if these products are part of an integrated firearms package unless we have guaranteed the entire package in writing. Please contact the original manufacturer for warranty information on all accessories and special-order items.

LAYAWAY

All sales are final. No substitutions, exchanges, price adjustments, or returns are allowed. The layaway period will begin on the order date and will end 90 calendar days from the order date. Layaway orders require a minimum order amount of $200.00 and a $25.00 set up fee will apply. The minimum first payment will be 25% of the order total plus the $25 set up fee. The maximum amount that can be put on layaway is 75% of the order total. You can cancel a layaway order at any time before your last payment is made. By notifying us of a cancellation you will forfeit all funds paid including the setup fee. No layaway will be held longer than 90 days. If we do not receive your final payments by the end of the term, we will cancel the layaway, and you will forfeit all funds paid. In the event of cancellation or ATF 4473 deny you will forfeit all funds paid. All Customers placing a Layaway order agree to all of GunZoneDeals.com's policies and terms of use.

DISPUTE RESOLUTION

By visiting GunZoneDeals.com, you agree that any disputes that could arise between you and GunZoneDeals.com Inc. or any of its affiliates shall be heard exclusively in the jurisdiction of the Federal District Court located in the Northern district of Indiana. In the event of a dispute Customers and/or Users agree to attempt to resolve the dispute by contacting GunZoneDeals.com Inc. at Sales@GunZoneDeals.com before taking any other action. Failure to contact GunZoneDeals.com Inc. to attempt to resolve the dispute prior to taking any other action will result in a breach of this agreement by the user. Any dispute arising out of or relating to the use of GunZoneDeals.com Inc.’s provided goods or service, or to any acts or omissions for which you may contend GunZoneDeals.com Inc. is liable, including but not limited to and dispute, shall be finally, and exclusively, settled by arbitration in Fort Wayne, Indiana, from which arbitration there shall be no appeal. The arbitration shall be held before one arbitrator under the Commercial Arbitration rules of the American Arbitration Association in force at that time. Arbitrators must be selected by following American Arbitration Association rules. The arbitrator shall apply the substantive law of the State of Indiana unless the interpretation and enforcement of this arbitration provision shall be governed by the Federal Arbitration Act. Any arbitration process must begin with written demand from either party. Each party will be fully responsible to cover their own incurred cost and attorney fees. Any judgment by the arbitrators may be entered in any court of competent jurisdiction in Indiana. The arbitrator shall not have the power to award damages in connection with any dispute more than the actual compensation of damages. The arbitrator shall not increase actual damages, award consequential, punitive, or exemplary damages, and each party irrevocably waives any claim to that. The agreement to arbitrate shall not be construed as an agreement to the joinder or consolidation of arbitration under this agreement with arbitration of disputes or claims of any non-party, regardless of the nature of the issues or disputes involved. This agreement provides that all disputes between Customers and/or Users and GunZoneDeals.com Inc. will be resolved by binding arbitration. This means Customers and/or Users give up the right to go to court to assert or defend rights. Customers and/or Users also give up the right to participate in or bring class actions. Customers and/or Users agree to waive the right to participate as a plaintiff or class member in any purported class action or representative proceeding. Customers and/or Users agree they cannot consolidate more than one person’s claims. Customers and/or Users rights will be determined by a neutral arbitrator and not a judge or jury. Customers and/or Users agree that if any provision or portion of this agreement is found invalid under any applicable statue or rule of law, then such invalidity shall not affect the validity of the remaining portions of this agreement. Customers and /or Users agree to substitute the invalid provision with a valid provision which most closely approximates the intent and economic effect of the invalid provision. Customers and/or Users agree by entering this agreement we are waiving the right to trial by jury or participate in a class action, private attorney general action, collective action, or other representative proceedings of any kind.

 

APPLICABLE LAW

By visiting GunZoneDeals.com, you agree to the laws of the state of Indiana. All Customers and/or Users agree service shall be solely based in Indiana and this service shall be deemed a passive website and service that does not give rise to personal jurisdiction over company, either specific or general, in jurisdictions other than Indiana. All terms of service shall be governed by the internal substantive laws of the State of Indiana, without respect to its conflict of laws principles. A printed version of these terms of service and of any notice given in electronic form shall be admissible in administrative or judicial proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
